What does your defense lawyer do at a first court date?

The first thing we do is make sure we have received discovery, that is, that we have received all the evidence from the State. If we have not received discovery, then there isn’t much we can do besides reset the case.

We will usually have a brief conversation with the prosecutor to get their initial offer and their take on the case. We may also share information about the case or our client to help move things forward.

At a first setting we may receive a plea offer from the State, in which case we will inform you of what the State is offering if you plead guilty. Finally the defense lawyer will speak with the court coordinator to get the pass slip ready for you to sign. Not very exciting, but like I said, first court dates are pretty boring in Kaufman County.

What if I do not have a lawyer at my first court date?

You do not want to go to court alone. If you have to go to court alone you are acting as your own attorney. Do not enter any plea agreements without a lawyer. It is nearly impossible to overturn a plea if you enter one. Instead, ask the court for more time to hire a lawyer. If you are indigent, the court may assign the public defender to assist you.
